Terms of Service

Altify Solutions ("Altify", "we", "us") is a software and cloud agency registered and operating in Kenya, providing custom software development, proprietary SaaS applications, IT consulting, and managed services.

You may use our website for lawful business purposes. You agree not to:

• Attempt unauthorized access to our systems, accounts, or data
• Introduce malware, scrape content at scale, or disrupt service availability
• Misrepresent your identity or affiliation when submitting forms
• Use content from this site for competitive intelligence or unlawful purposes

Information on this website is provided for general guidance and does not constitute legal, tax, or financial advice.

Access to Altify applications (Leesify ERP, LeefiPay, eTIMS Integrator, RMS, iProduction, HRM, and related products) requires a valid subscription or license agreement. You are responsible for:

• Maintaining confidentiality of account credentials
• All activity under your account
• Ensuring users comply with applicable laws, including KRA tax and data protection requirements
• Providing accurate business information for payment gateway and eTIMS registrations

We may suspend access for non-payment, security risks, or material breach of these Terms or your Client Agreement.

All trademarks, logos, software, documentation, designs, and content on this website remain the property of Altify Solutions or its licensors unless otherwise stated.

Custom software IP ownership is defined in your Client Agreement. Unless explicitly transferred, pre-existing Altify frameworks, libraries, and ecosystem modules remain Altify property, licensed to you for use as specified in your agreement.

You retain ownership of data you upload or generate in Altify systems. You grant Altify a limited license to host, process, and display your data solely to provide the services. You represent that you have the right to provide such data and that its processing complies with applicable law.

Fees, billing cycles, and payment methods are specified in your Client Agreement or product pricing page. Unless otherwise stated:

• Quotes are in Kenyan Shillings (KES) unless agreed otherwise
• Invoices are due within the period stated on the invoice
• Late payments may incur suspension of services and interest as permitted by law
• Third-party fees (hosting, SMS, M-Pesa, domain registration) may be passed through at cost

Support scope, response times, and uptime commitments are defined in your Client Agreement or support plan. We strive for high availability but do not guarantee uninterrupted service except where an SLA explicitly applies.

Each party agrees to protect the other's confidential information disclosed during engagements, using at least reasonable care, and to use it only for the purpose of the engagement. This obligation survives termination for three (3) years, except for trade secrets and data protected by law.

We warrant that professional services will be performed with reasonable skill and care. Except as expressly stated in a Client Agreement, services and the website are provided "as is" without warranties of merchantability, fitness for a particular purpose, or non-infringement.

You are responsible for verifying that configured integrations (M-Pesa, eTIMS, payroll statutory rates) meet your compliance obligations.

To the fullest extent permitted by Kenyan law, Altify shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.

Our aggregate liability arising from these Terms or any Client Agreement shall not exceed the fees paid by you to Altify in the twelve (12) months preceding the claim, except where liability cannot be limited by law.

You agree to indemnify Altify against claims arising from your misuse of the services, violation of these Terms, infringement of third-party rights by your content, or failure to comply with applicable laws.

We may terminate or suspend access for breach of these Terms. You may terminate subscriptions according to your Client Agreement. Upon termination, we will provide data export where contractually required and delete client data per our Privacy Policy and agreement terms.

These Terms are governed by the laws of the Republic of Kenya. Disputes shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to the courts of Nairobi, Kenya, unless otherwise agreed in writing.

We may update these Terms periodically. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance where permitted by law.
